Measures for Administrative Penalties for the Environment (No.8 Order of the Ministry of Environmental Protection of the People¡¯s Republic of China) |
This regulation is formulated for the purpose of setting standards for imposing administrative penalties for the environment, supervising and safeguarding the competent environmental protection department for exercising this duty by law, safeguarding the public interests and social orders, and protecting the legal rights and interests of citizens, legal persons and other organizations, according to the Law of the People¡¯s Republic of China on Administrative Penalty and relevant laws and regulations. |

If a citizen, legal person or other organization is subject to administrative penalties due to violation of the environmental protection laws, regulations and other rules, the procedures provided by Law of the People¡¯s Republic of China on Administrative Penalty and by this regulation shall be followed. |
|
The enforcement of environmental administrative penalties shall safeguard by law the legal rights and interests of citizens, legal persons and other organizations and keep the technological and commercial secrets of those concerned. |
|
The enforcement of environmental administrative penalties shall follow the principle of separating the investigation of evidence from decision for penalties and dividing the decision and collection of penalties. |
|
The enforcement of environmental administrative penalties shall not exempt the obligation of the parties concerned to pay emission fees. |
|
This regulation shall go into effect as of March 1, 2010. |
|
The Measures for Administrative Penalties for Environmental Protection, which was issued by the former State Environmental Protection Administration on August 6, 1999, shall be abolished. |

Measures on the Recording of Local Environmental Quality Standards and Emission Standards (No.9 Order of the Ministry of Environmental Protection of the People¡¯s Republic of China) |
This regulation is formulated for the purpose of improving the recording of local environmental quality standards and emission standards, and according to the Environmental Protection Law of the People¡¯s Republic of China, the Air Pollution Prevention and Control Law of the People¡¯s Republic of China, and Water Pollution Prevention and Control Law of the People¡¯s Republic of China. |

This regulation shall apply to the recording of local environmental quality standards and emission standards that are formulated by law by the people¡¯s governments of provinces, autonomous regions and municipalities directly under the Central Government. |
|
The management of local emission standards of air pollutants from vehicles and vessels shall comply with Measures on the Examination and Approval of Local Emission Standards of Air Pollutants from Vehicles, which was approved by the State Council and issued by the former State Environmental Protection Administration. |
|
Local environmental quality standards and emission standards refer to the environmental quality standards and emission standards that are formulated by the people¡¯s governments of provinces, autonomous regions and municipalities directly under the Central Government and that are applicable to their administrative jurisdictions or to particular river basins and regions within their administrative jurisdictions. |
|
Any institution other than the people¡¯s governments of provinces, autonomous regions and municipalities directly under the Central Government shall not approve local environmental quality standards and emission standards. |
|
This regulation shall go into effect as of March 1, 2010. |
|
Measures on the Recording of Local Environmental Quality Standards and Emission Standards, which was issued by the former State Environmental Protection Administration on November 11, 2004, shall be abolished. |

Cleaner production standard-Hotel (HJ 514-2009) |
This standard is formulated for the purpose of implementing Environmental Protection Law of the People¡¯s Republic of China and Cleaner Production Law of the People¡¯s Republic of China, protecting the environment, and providing technical supports and guidelines on cleaner production for the hotels. |

This standard provides the general requirements for hotels to conduct cleaner production on the basis of meeting national and local emission standards and in line with the existing technological, equipment and managerial levels of this industry. |
|
This standard includes three levels, the first level represents the international advanced level of cleaner production, the second represents domestic advanced level of cleaner production, and the third represents domestic basic level of cleaner production. This standard shall be amended at a proper timing with the technological development. |
|
This standard is applicable to the assessment of cleaner production of hotels, the estimation of the potential and chance of cleaner production, the performance assessment of cleaner production and the performance disclosure system for cleaner production, as well as environmental management systems like environmental impact assessment and pollutant discharge permit. |

This standard provides the procedures, requirements, contents, and methods for the supervision and management to the operation of centralized incineration disposal facilities for hazardous wastes. |

This standard is applicable to the supervision and management to the operation of profitable and centralized incineration disposal facilities for hazardous wastes. The supervision and management to the operation of other incineration disposal facilities for hazardous wastes may refer to this standard. |

This standard is formulated for the purpose of implementing Environmental Protection Law of the People¡¯s Republic of China, Law of the People¡¯s Republic of China on the Prevention and Control of Environmental Pollution by Solid Waste, Measures on the Administration of Operation Permit of Hazardous Wastes, and Regulations on the Management of Medical Waste, strengthening the supervision and management to the operation of incineration disposal facilities for medical wastes, and ensuring the standard operation of such facilities. |

This standard provides the prevention and control of pollution caused by the collection, storage, transportation, and recycling of waste lead-acid batteries as well as the requirements for lead recycling businesses. |
|
This standard is applicable to the control of pollution caused by the collection, storage, transportation, and recycling of waste lead-acid batteries and shall be a guidance to recycling businesses for their site selection, construction and post-construction pollution control. |
