Department of Policies, Laws and Regulations

Main functions:

Responsible for establishing sound environmental protection laws, administrative regulations, and economic policies; draw up national guidelines, general policies and macro strategies on environmental protection; draw up the law-making programs and plans in the environmental protection sector and organize their implementation; organize the drafting of the general laws, administrative regulations and departmental rules in the environmental protection sector; work as the focal point to coordinate and review the specific laws, administrative regulations, and departmental rules on environmental protection and submit them for approval; gather the opinions when the National People's Congress, Legislative Affairs Office of the State Council, and other departments under the State Council consult the Ministry on the environmental impacts of the draft laws and administrative regulations; responsible for the interpretations on the environmental protection laws, administrative regulations, and departmental rules; organize the administrative reconsideration and compensation as well as the response to the litigations in the environmental protection sector; guide the national environmental protection branches on the administrative reconsideration; cooperate with the judicial departments on the trial of environmental criminal cases and the judicial interpretations in the environmental protection sector; organize the formulation of the standards and the technical specifications for defining the environmental issues in civil, administrative, and criminal cases; guide and supervise the administration by law in the environmental protection sector; guide the popularization of environmental legislations across the country; take the lead to promote the building of an environment-friendly society; contribute to developing the environmental economic policies in the fiscal, taxation, trade, credit, securities, insurance, pricing, and fee-charging areas; organize the formulation of comprehensive catalogues in the environmental protection sector, including the catalogues of the products, techniques, and equipment that cause heavy pollution and high environmental risks as well as the catalogues of the products, techniques, and equipment that are supported by national environmental policies; organize the post-evaluation of the environmental policies and the administrative regulations; guide and facilitate the development of the local environmental economic policies; work as the focal point to formulate national legislations for implementing the international environmental conventions.
